§ Privacy Policy
§ 1 General Information
Your personal data (e.g. title, name, address, email address, telephone number) is processed by us solely in accordance with the provisions of German data protection law and the data protection law of the European Union (EU). The following provisions inform you about the purposes of processing, recipients, legal bases, storage periods, your rights, and the controller responsible for your data. This privacy policy applies only to our websites. If you are redirected to other websites via links on our pages, please refer to the privacy policies provided there.
§ 2 Contacting Us
(1) Purpose of Processing
We process your personal data that you provide to us by email, contact form, etc., solely for the purpose of responding to and handling your inquiries. You are not obliged to provide us with your personal data. However, without your email address, we will be unable to respond to your request via email.
(2) Legal Basis
a) If you have given us explicit consent to process your data, Art. 6(1)(a) GDPR serves as the legal basis for the processing.
b) If we process your data to carry out pre-contractual measures, Art. 6(1)(b) GDPR serves as the legal basis.
c) In all other cases (especially when using a contact form), Art. 6(1)(f) GDPR serves as the legal basis.
RIGHT TO OBJECT: You have the right to object to data processing based on Art. 6(1)(f) GDPR at any time for reasons arising from your particular situation, unless the processing is for direct marketing purposes.
In the case of direct marketing, you may object to processing at any time without stating reasons.
(3) Legitimate Interest
Our legitimate interest in processing is to communicate with you quickly and respond to your inquiries cost-effectively. If you provide us with your address, we may use it for postal direct marketing. You can protect your interest in privacy by providing minimal data (e.g. using a pseudonym).
(4) Categories of Recipients
Hosting providers, shipping service providers for direct mail campaigns.
(5) Retention Period
Your data will be deleted once it is clear from the circumstances that your inquiry or the relevant issue has been conclusively resolved.
If a contract is concluded, we retain the data required under commercial and tax law for the legally specified periods, usually ten years (§ 257 HGB, § 147 AO).
(6) Right of Withdrawal
If the processing is based on your consent, you have the right to withdraw this consent at any time.
§ 3 Your Rights as a Data Subject
If your personal data is processed, you are a data subject within the meaning of the GDPR and have the following rights toward us as the controller:
Right of Access
In accordance with Art. 15 GDPR, you may request information about your personal data processed by us.
Right to Rectification
If the information concerning you is not (or no longer) accurate, you may request rectification in accordance with Art. 16 GDPR. If your data is incomplete, you may request completion.
Right to Erasure
Under the conditions of Art. 17 GDPR, you may request the deletion of your personal data.
Right to Restrict Processing
In accordance with Art. 18 GDPR, you have the right to request restriction of the processing of your data.
Right to Data Portability
Pursuant to Art. 20 GDPR, you have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, or to request transmission to another controller.
Right to Withdraw Consent
According to Art. 7(3) GDPR, you have the right to withdraw your consent at any time. The withdrawal does not affect the lawfulness of the processing carried out based on the consent before its withdrawal.
Right to Lodge a Complaint with a Supervisory Authority
If you believe that the processing of your personal data violates the GDPR, you have the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR (especially in the Member State of your residence, place of work, or the place of the alleged infringement).
Please also note your right to object under Art. 21 GDPR:
a) General: Justified Objection Required
If the processing of your personal data is
necessary to safeguard our overriding legitimate interests (legal basis Art. 6(1)(f) GDPR), or
carried out in the public interest (legal basis Art. 6(1)(e) GDPR),
you have the right to object to the processing at any time for reasons arising from your particular situation. This also applies to profiling based on these provisions.
In the event of an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or if the processing serves the establishment, exercise, or defense of legal claims.
b) Special Case of Direct Marketing: No Justification Required
If your personal data is processed for the purpose of direct marketing, you have the right to object to this processing at any time without giving reasons. This also applies to profiling related to direct marketing.
If you object to processing for direct marketing purposes, your personal data will no longer be used for such purposes.
